Warranty & Disclaimer

Rusco warrants to the original purchaser, that its products will be free from original defects in material and workmanship.

Rusco will repair or replace all parts without charge, found to be defective under normal use and service within the warranty period upon return of products at customer’s expense.

The components of all RUSCO products are warranted for a period of 12 months from date of original sale. RUSCO’s liability is solely limited to the original cost of the part.  RUSCO will not be responsible for incidental or consequential damages. No agent or representative has the authority to waive or alter this printed warranty.
 
THIS WARRANTY PERIOD IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE.

RUSCO reserves the right to redesign or modify its products without incurring further liability. Prices are subject to change at any time without notice.

‍Indemnity
‍You agree to defend, indemnify and hold Rusco, its directors, officers, employees, agents and affiliates harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable attorneys’ fees, in any way arising from, related to or in connection with your use of the Site, your violation of the Terms or the posting or transmission of any materials on or through the Site by you, including, but not limited to, any third-party claim that any information or materials you provide infringes any third-party proprietary right. 

These Terms shall be governed by, construed and enforced in accordance with the laws of the State of Florida, without giving effect to any conflict of law provisions. Any dispute relating in any way to these Terms, your visit to the Site, or to any purchase, return or other transaction with Rusco shall be submitted to confidential arbitration in Tampa, Florida. However, if you have in any manner violated or threatened to violate any Rusco Intellectual Property right, we may seek injunctive or other appropriate relief in any state or federal court in the state of Florida. You consent to exclusive jurisdiction and venue in these courts. Any arbitration under this agreement and these Terms shall be conducted under the prevailing rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.
